INTERNATIONAL COMMERCIAL ARBITRATION

Based in Geneva, James Tidmarsh conducts an active international arbitration practice, initiating and defending arbitration proceedings under the rules of the International Chamber of Commerce ("ICC"), the Geneva and Zürich Chambers of Commerce, UNCITRAL, the American Arbitration Association ("AAA"), the International Centre for the Settlement of Investment Disputes ("ICSID"), the World Intellectual Property Organization ("WIPO"), and other arbitral institutions.

James Tidmarsh has helped secure success for clients in a number of large-scale international arbitrations, including:

The defense before an Arbitral Tribunal in Paris of a European affiliate of a U.S. entertainment company of more than US$100 million in contractor claims arising out of the construction of a large infrastructure project in France;
The representation of an Indian company before an ICC Tribunal sitting in Zürich in a claim against a German company in connection with a contract for the construction of a state-of-the-art textile manufacturing facility;
The ongoing representation before an ICSID Tribunal of a British company in a claim for more than US$500 million in connection with the expropriation of a mining operation in a Central African country, and the cancellation of various mining concessions;
The successful representation of a Korean construction firm in the prosecution of claims of over 50 million Deutsch Mark against a defaulting subcontractor on a major construction project in the Russian Federation;
An award of 214 million New Taiwanese Dollars on behalf of a Taiwanese chemical company in a matter before an ICC Tribunal in Zurich under Swiss law involving the explosion of an industrial boiler;
The upholding of a complex series of contracts for the operation of a hotel and casino complex in Europe on behalf of a U.S. client in arbitration proceedings in Geneva;
The ongoing representation of numerous corporate and governmental clients in the assertion of their claims before the United Nations Compensation Commission (UNCC), the Geneva-based body established to pay damages arising from Iraq's invasion of Kuwait and the subsequent Gulf War;
The representation of a US-based multi-national in a claim in international arbitration before WIPO in Geneva in connection with rights over a particular website domain name or so-called "URL".
